RADIO I host a two hour real estate talk radio show here in Phoenix, Arizona. I consider this my fun day because I am able to share my thoughts and findings to the public when it comes to real estate. Furthermore, I am here to serve the public to get their questions answered by local professionals. Yes, I do receive live call ins. One must be prepared at any given moment for a call. Did I mention I ALWAYS do a live show. Why? I do live shows because people expect it. They want a real person.

I had a caller on Saturday who wanted to obtain my opinion on the real estate market. So, I gladly gave it since he asked me. I said the real estate market will conintue at a steady pace since rates are low with plenty of inventory left. I do not expect the banks to flood the markets with millions of foreclosures because that would adversely damage the overall US economy by driving down both real estate prices and consumer confidence. Hey, it was my opinion based upon my research and being in the real estate market daily.

The caller had a different opinion. He informed me that banks will unleash their inventory along with a continued increase in home foreclosures from ARMs adjusting in the next 24 months. He said that he will prefer to wait another year to eighteen months until he buys a home. I can respect his opinion. However, there is one flaw in it. We are not promised tomorrow. So, we must live for today and continue to plan for the future. Nobody has a crystal ball to predict the future.

TITLE INSURANCE A MUST IN PHOENIX, ARIZONA HOMES

Real estate is a part of everyone's life. We see real estate for sale or lease on a daily basis via Internet, television, radio, and newspaper. The definition of title means an owner has the right to maintain or sell real estate in his/her possession. The owner has the right to enjoy the property. Title is the history of ownership of a parcel of land. Title companies do title searches to ensure that a buyer will have clean title when purchasing a piece of real estate. They want to ensure there is a true hand over of the property to the new owner without any blemishes on title. This service is provided by your local title agency. Title is another word for "right" or "interests" when it comes to real estate.

A title insurance policy is written against the property after thorough research from the title company. Title insurance is the company's opinion concerning ownership and marketability of title on the property. The buyer is purchasing the title insurance from experts. This means the title company is backing their research and willing to issue a title insurance policy on the land. Title insurance policies do not cover the following:

  • Defects in title known to the insured
  • Liens not on public records
  • Easements
  • Interests of parties in possession
  • Survey matters

The reasons for issuing title insurance are twofold. The mortgage company wants to ensure that they will be able to put a mortgage on the property with no issues. The buyer wants to enjoy the property they just purchased with no problems. The owner wants to make sure that their real estate is marketable and will be able to sell, lease, or mortgage the property with no worries.

The title insurance policy protects the lender if there is a title issue. One must purchase an owner's policy to protect oneself. If not, it would be very costly if a title issue would arise down the road. Many times you can ask for a lower rate if you purchase from the seller's previous title company. I always believe in asking for a discount.

Conclusion

First, I would advise to ask the escrow title officer to explain the title insurance policy in detail in what it covers and does not cover. The escrow title officer is a great source of information since they perform this type of service on a daily basis. Another person to ask would be a real estate lawyer. I would highly advise to hire a real estate lawyer for an hour or two to review the title insurance documentation for one's protection.

The mortgages are low, home buyer tax credit has been extended until 4/30/2010, and it is a great time to purchase a home. However, there are some buyers that need assistance when it comes to their credit. They are excited about purchase a home. They have a loan officer pull their credit to be informed that they have some old issues that they must clean up before they purchase a home. They never guide these people to a credit consultant. Why? They do not know any better.

The National Association of Realtors and other leading organizations lobbied for this law to jump start the real estate industry after a heavy hit for the past two years. The real estate industry got us into this slump and it has to get us out of this rut. I know many people will be in position to purchase homes at the start of the year here in Tempe, Arizona. We are coming up to the busiest season in real estate and I am ready for it.

Home Buyer Tax CreditA person is considered a first time home buyer when he/she has not owned a primary home in the past three years. They are eligible to receive up to an $8,000 home buyer tax credit or 10% of the value of the home which ever is less. The home must be a principal residence. The credit is refundable even if one does not owe taxes. Many people have taken full advantage of this tax credit since it has been in place.

Existing home owners who have lived in their primary house for five years or more will be eligible for a $6,500 home buyer tax credit. There are income limits to include $125,000 for single filers and $225,000 for joint filers. These are exactly the same for first time home buyers in the above paragraph. The credit will be gradually phased out for single people who make over $145,00 and married couples that make over $245,000.

This bill has been extended with the following important dates:

  1. All contracts must be dated by April 30th, 2010
  2. All deals must close on or before June 30th, 2010 to receive the tax credit

It is very easy to obtain your tax credit. First, you can amend your 2009 tax file or you can file it in 2010 tax return. Yes, you will need to send proof that you purchased the house. I would suggest sending in a copy of ones mortgage statement and HUD1 statement for proper documentation.

The Treasury Department has detected a lot of fraud regarding people falsifying documents to receive the tax credit. Personally, it is not worth the amount of money to create a fraud when it comes to the tax credit. I would recommend to take the high road because they will always catch you in the end.
